Kenai Peninsula Borough, AK Home Business: Home Daycare (2026)

Home-based child care in the unincorporated Kenai Peninsula Borough is treated differently depending on which zoning district a property sits in, because the borough has no general zoning outside its Local Option Zoning Districts (LOZDs). In the borough's standard LOZD residential zones, R-1, R-R, R-W and R-M, KPB 21.44.130(E) lists 'in-home adult or child care, or preschool' among the home occupations allowed without a separate permit, subject to the section's standards. KPB 21.44.130(C)(6) specifically allows the operation to use outdoor space on the lot, as long as the area used for the daycare or preschool is fenced for the safety of the children or adults on the premises; every other home occupation must stay entirely inside the dwelling and accessory buildings.

The daycare must still meet the section's other continuing standards under (D), including the 20-vehicle-trip traffic cap in (C)(2), the ban on outside storage, and the one-sign limit in (C)(4). The rule flips in the North Fork One LOZD near Homer: KPB 21.40.100(B)(10) lists 'licensed day care' as a home occupation the planning commission can never approve there, alongside kennels, restaurants and repair stations. Operators must still carry any state childcare license the activity requires, because KPB Chapter 21.44 governs only the borough's zoning treatment of the use, not state licensing. Outside any adopted LOZD, the rest of the unincorporated borough has no zoning-based rule addressing home daycare at all.
