Section 5.12.2.A of the Land Development Regulations sets tiered group-size limits for a family day care home: up to four children from birth to twelve months, or three infants plus other children up to six total, or six preschoolers if all are over twelve months, or up to ten children if no more than five are preschool age and no more than two of those five are under twelve months. Subsection B.2 requires family day care homes to be separated by at least 1,000 feet from any other child care use, family day care home, large family day care home, adult day care, or special residential facility, measured by the shortest airline distance between the nearest points of each property, though homes lawfully operating before February 15, 2008 are grandfathered even if closer together.

The operator must be an owner-occupant, and every property owner, day care owner, and occupant age thirteen or older is subject to a background check; the city will not issue a local business tax receipt if that check turns up a specified criminal conviction under Section 5.2.3. A large family day care home is prohibited outright under Section 5.12.3 unless it was already licensed with the Florida Department of Children and Families before February 15, 2008.
