The Madison Zoning Ordinance treats in-home child care as a home occupation under Article XIV. Family day care for not more than six children qualifies as a minor home occupation permitted by right, and the one-room limit does not apply to family day care facilities. Group day care caring for more than six but no more than twelve children is a major home occupation, which requires a special exception under Section 10-8. In residential day care facilities, outside play is permitted to the extent required by State day care regulations, and State-approved substitute workers may participate, but the licensee and day care operator must be the same individual.
