Newark, OH Home Business: Home Daycare (2026)

Section 1248.02 of the Newark Code of Ordinances lists permitted uses in the RS Suburban, RL Low Density, RM Medium Density and RH High Density single-family districts of the City of Newark, Ohio. Item (b) is day care in the home of the provider for not more than six. It sits in the permitted list with single-family dwellings, public parks, golf courses, and flagpoles and antennas, while conditional uses such as a home occupation are handled separately in § 1248.04 and need Board approval under Chapter 1234.

Section 1248.01 states the purpose of these districts as an area solely for single-family residential uses. The Zoning Code definition in § 1230.04(43) reads day care as the providing of personal care and supervision for children or adults or preschool education on less than a twenty-four hour basis. The same six-person wording appears for the AD Agricultural District in § 1247.02(j). Parking for the home is governed by § 1248.09, which sends off-street parking and loading to Chapter 1290. Section 1248.06(b) still applies on a day care lot: the sale or display for sale of more than five vehicles in any twelve month period, the long-term parking or storage of vehicle(s) associated with a business, and the providing of a service on a repeated basis not approved by the Board are prohibited. Because the provision is a use permission, the Zoning Inspector enforces it through the notice process in § 1232.99.
