Town Code § 13-04-040(B) conditionally permits in-home child care as an accessory use to any legal dwelling, but only for no more than five children in the home at one time. The provider must meet every requirement of paragraph A and be licensed by the applicable state or county agency. Where the care is not subject to state or county licensing, the provider must instead obtain a conditional use permit under § 13-13-090. Paragraph C(8) expressly prohibits in-home child care with six or more children as a home occupation, so a sixth child moves the operation out of the home-occupation category.

Child day care does get relief from two traffic limits: the 7 a.m. through 9 p.m. customer-hours rule in A(11) and the five-clients-per-day, one-client-at-a-time rule in A(12) both state that the limitation does not apply to child day care and community residences. The remaining paragraph A conditions still apply, including the 25% building-use cap and 200 square foot detached-building cap, the off-street parking rule that bars parking in a required front yard, the ban on exterior changes by lighting or graphics, and business registration under Article 8-02.

The residential use table in § 13-04-010 lists Nursery school only in the RS zone, as a conditional use. In commercial zones, § 13-05-010(D)(26) places day nurseries, nursery schools or private kindergartens in the Service A Uses category. Under § 13-13-110(B), any conditional use permit is a matter of discretion, not of right.
