Full Breakdown
Section 13-10-060 of the Prescott Valley Town Code requires off-street loading space in all zoning districts except AG (agricultural), on each premises with one or more buildings occupied by a use that receives or distributes materials or goods. The schedule is by total floor area of the building: one space up to 30,000 square feet, two spaces from 30,001 to 50,000 square feet, three spaces from 50,001 to 150,000 square feet, and one additional space for each additional one to 100,000 square feet.
Subsection C controls location. Required loading space is not permitted in any front yard, and not in a required side yard except in a non-residential zoning district where a side yard abuts an alley within and that abuts only non-residential zoning districts. Loading space can occupy all or part of a required rear yard and can be partially or entirely enclosed within a building, but it is never counted as off-street parking space. Under subsection D, an alley within and abutting only non-residential zoning districts can serve as maneuvering space. Subsection E sets the minimum size of each space at 12 feet wide, 45 feet long, and 14 feet high, exclusive of access aisles and maneuvering space.
The site development article adds screening. Section 13-11-050(D)(3) requires loading, delivery, or service areas to be oriented away from public streets or screened by six-foot high screen walls with adjacent screening landscaping, and screened from contiguous residential zoning districts by six-foot high screen walls and screening trees. Overhead bay doors must face away from major streets, highways, and contiguous residential districts or be screened the same way. Section 13-10-060 was rewritten by Ordinance No. 2024-947 on December 11, 2024, and previously stood at section 13-24-060; the loading rule was first enacted by Ordinance No. 152 on July 2, 1987.
Violations & Fines
A violation of the loading requirements is a violation of Chapter 13. Section 13-15-020 makes it unlawful to use land in violation of the Chapter and treats each individual day a violation continues as a separate offense. Under section 13-15-030, a person found guilty is guilty of a Class 3 misdemeanor unless the Chapter specifies otherwise, and section 13-15-040 lets the Council, the Town Attorney, the Zoning Administrator, or a property owner with legal standing seek injunction, mandamus, or abatement.
