Full Breakdown

Section 13-07-090(D) sets maximum heights for fences, walls, screen walls, hedges and shrubbery, subject to the sight visibility triangle requirement of § 13-07-120. On a residentially zoned lot the limit is four feet in the front yard and six feet in side or rear yards. On commercially zoned lots it is six feet along the front lot line and along the side lot lines to the face of the nearest building, and eight feet behind the face of the nearest building and along the rear lot line. On industrially zoned lots it is eight feet.

Corner lots get their own rule. A fence or freestanding wall on the exterior side lot line of a corner lot, or between that line and the required exterior side setback line, cannot exceed four feet. Exterior side fences outside the required exterior side setback area can reach six feet. On corner lots in a PD zone, a fence or wall in the setback area can be six feet as long as it is not closer than ten feet to the back of the adjacent curb.

Height is measured as the vertical distance from the finished grade on the higher side to the top of the fence. A freestanding wall cannot differ by more than one foot in height from one side to the other; if topography requires more, a retaining wall must be installed and set back at least five feet. Decorative gates and entrance ways can reach a maximum of nine feet if their width does not exceed 25% of the lineal footage of the attached fence or wall along that property line.

Section 13-07-120 fixes the triangles. At street intersections the triangle is formed by the right-of-way lines at 33 feet from their intersection. At driveways it is formed by the edge of the driveway and the street right-of-way at ten feet from their intersection. Inside the triangle, nothing other than a post, column or tree not exceeding one foot in diameter can obstruct vision between three feet and ten feet in height.

Violations & Fines

A fence taller than its limit, or any fence above three feet inside a sight visibility triangle, violates Chapter 13. Section 13-15-030 makes a violation a Class 3 misdemeanor unless the Chapter specifies otherwise, and under § 13-15-020(B) each day is a separate offense. The Town Council, Town Attorney or Zoning Administrator can seek abatement under § 13-15-040, which can mean removal or cutting down of the offending fence or hedge.

Frequently Asked Questions

How tall can my front yard fence be in Prescott Valley?
On a residentially zoned lot, § 13-07-090(D)(1) allows four feet in the front yard and six feet in side or rear yards. On a corner lot, a fence on the exterior side lot line or in the required exterior side setback area cannot exceed four feet, and any fence near an intersection must also stay within the three-foot sight triangle cap.
What is the sight visibility triangle at an intersection?
At street intersections it is the triangular area formed by the right-of-way lines of the intersecting streets at 33 feet from the point of their intersection, under § 13-07-120(A)(1). Inside it, no structure, fence, wall or hedge can exceed three feet in height. The Town Engineer determines the intersection point where projected right-of-way lines are used.
Do driveways have a sight triangle too?
Yes. At driveways the triangle is formed by the edge of the driveway and the street right-of-way at ten feet from the point of their intersection. The same restrictions apply there: no structure, fence, wall or hedge above three feet, and no vision obstruction between three feet and ten feet other than a post, column or tree up to one foot in diameter.
Can I build a taller entry gate?
Decorative gates and entrance ways can exceed the fence limits up to a maximum of nine feet, provided the width of the gate or entrance way does not exceed 25% of the lineal footage of the attached fence or wall along the property line. In no instance can the decorative gate or entrance way exceed nine feet in height.
