D. Large Family Day Care Homes—Development Standards. Large family day care homes can operate in a residential zoning district provided that a large family day care permit has been issued in compliance with the conditions and the procedures specified herein prior to establishment of the facility:

6. There shall be a minimum distance of 1,200 feet between the parcel on which the large family day care is located and the nearest other parcel containing a large family day care. The minimum distance required by this Section shall be measured from the nearest property line to the nearest property line.

7. A 6-foot high masonry wall shall be installed on the side and rear yard property lines adjacent to other residential uses.

Full Breakdown

550, must be obtained before the home is established, and the applicant must live in the home as a principal residence and provide written evidence of residency. The Section imposes a citywide dispersal rule: a large family day care home must be at least 1,200 feet, measured property line to property line, from the nearest other large family day care home, preventing clustering of these uses within a single neighborhood. Development standards layer on top of the permit: the use must remain clearly incidental and secondary to the home's residential character, the property cannot be structurally altered in a way that changes its residential appearance, the garage cannot be used for caregiving, and no exterior sign may identify the home as a day care.

A 6-foot masonry wall is required along side and rear yard lines adjacent to other residential uses, four off-street parking spaces must be maintained, two of which may be in the garage, a drop-off area is required if the home fronts a major arterial street, and at least 1,000 square feet of contiguous rear-yard open space must be provided. Notice of the permit application goes to neighboring property owners, who have 10 days to request a public hearing before the Planning Commission.

Violations & Fines

Operating a large family day care home without the required Administrative Use Permit, or violating any of its site-distance, wall, parking, or residency conditions, is a Title 17 violation. Section 17.650.010 makes such a violation a public nuisance abatable by injunction and a misdemeanor, prosecutable as an infraction at the City Attorney's discretion, with each day of continued violation a separate offense.

Frequently Asked Questions

Do I need a permit to run a large family day care home in Westminster?
Yes. Section 17.400.035.C requires an Administrative Use Permit before a large family day care home can operate in a residential zone, processed under Chapter 17.550. Neighboring property owners receive notice and have 10 days to request a hearing before the Planning Commission if they object.
How close can two large family day care homes be to each other?
At least 1,200 feet apart. Section 17.400.035.D.6 measures that distance from the nearest property line of one large family day care parcel to the nearest property line of the other, a citywide dispersal rule meant to prevent clustering in one neighborhood.
What site improvements does a large family day care home need?
A 6-foot masonry wall along side and rear yards next to other homes, four off-street parking spaces, two of which may be in the garage, at least 1,000 square feet of contiguous rear-yard open space, and a drop-off area if the home fronts a major arterial street, per Section 17.400.035.D.
