Under Section 21-63 of the Winter Haven Unified Land Development Code, family foster homes, family day care homes and adult family-care homes are grouped together in the Table of Land Uses (Table 21-31(A)) and permitted outright in every residential zoning district, from AG and RE through R-5 and RM. The City treats them as a state licensing matter rather than a local zoning question: because the operator lives in the home and only a small number of people are cared for at a time, the code says these uses "are not subject to local zoning laws," leaving Florida Statutes to control licensing, registration and occupancy limits.

That does not mean the City imposes nothing. Section 21-63(b) forbids any exterior sign identifying the purpose or nature of the facility, even though state law otherwise authorizes the use in a residential district, so a home day care cannot post a business sign the way a home-based office might. Section 21-63(c) requires outdoor play areas and playgrounds to be shaded a minimum of fifty percent by canopy trees, with the approved species list found in Article III, Section 21-127 of the same code. Section 21-63(d) folds state compliance directly into the City's own enforcement: any violation of the applicable Florida Statutes governing the home's license or operation is automatically deemed a violation of the Winter Haven Code as well, and is grounds for terminating the use altogether.

Larger operations, such as stand-alone child care centers not family-occupied, instead fall under Section 21-64's rules for nursing homes and other care facilities, treated as commercial uses subject to ordinary zoning review.
