Appendix B Section 5.2.J.9 of Wylie's Zoning Ordinance treats most home-based businesses as an accessory Home Occupation subject to eight compatibility standards covering signage, traffic, storage, and residential appearance. The ninth provision carves out an exception for child care: as defined by the Human Resource Code, Chapter 42 an In-home Day Care or a Family home that is certified, listed or registered with the State of Texas is exempt from this Ordinance, and governed by the rules and regulations of the State of Texas. That means a qualifying in-home day care or family home does not have to satisfy the zoning code's home-occupation traffic limit, its ban on on-premise signage, or its restriction on visible merchandise and outdoor storage, because the exemption removes the use from the ordinance entirely rather than granting a variance from it.

Regulation instead falls to the state agency responsible for certifying, listing, or registering the home under Human Resources Code Chapter 42, which sets its own capacity limits, inspection schedule, and caregiver requirements. A day care that has not been certified, listed, or registered with the State of Texas does not qualify for the exemption and remains subject to the full Home Occupation standard at Section 5.2.J.9, including the Special Use Permit trigger for uses like sober living homes and the general traffic and signage limits that apply to ordinary home businesses.

Wylie's Building Inspections and Code Enforcement staff can ask an operator to show proof of state certification, listing, or registration before treating the property as exempt from the local zoning standard.
