Home occupations are allowed as an accessory to a residential dwelling under City Code Chapter 11 (Zoning), subject to accessory-use standards that protect the residential character of the neighborhood.
Under Cedar Park Chapter 11 (Zoning), Article 11.05 (Accessory Use, Building, and Structure Standards), a home occupation is permitted as an accessory to the principal residential use. The occupation must be conducted entirely within the dwelling unit that is the legal residence of the practitioner, or entirely within only one accessory garage building (carports and pole barns are excluded). No persons other than family members residing in the dwelling may be employed in the home occupation on the premises. The residential character of the lot and dwelling unit must be maintained, and neither the interior nor the exterior of the dwelling may be structurally altered in a way that would require compliance with nonresidential construction codes. The sum of all accessory uses (including the home occupation) in the principal building cannot exceed 25 percent of the total gross floor area of the principal building. Texas HB 2127 (effective Sept. 1, 2023) preempts municipal regulation of occupations in certain fields, but local zoning over land use remains in force.
Zoning violations are prosecuted as Class C misdemeanors. Under Code Β§1.01.009 (General Penalty), violations of the zoning code may be fined up to $2,000 per day, and each day a violation continues is a separate offense. Code Compliance issues a written notice with a cure period before citation.
