Home occupations are permitted in Cupertino's residential zones under Municipal Code Chapter 19.120, provided the business is clearly incidental and secondary to residential use and does not change the neighborhood's residential character. In R1 zones they are a permitted use per CMC 19.28.030.
Cupertino allows home occupations in residential zones and other areas where residential use is permitted, under CMC Chapter 19.120. The business must be clearly incidental and secondary to the dwelling's residential use, must not change the residential character of the property or neighborhood, and must not be detrimental to health, safety, welfare, or property values. In single-family (R1) districts, home occupations conducted under Chapter 19.120 are a listed permitted use (CMC 19.28.030). Certain intensive uses are excluded (see permits). Activity is confined to the main dwelling or an accessory building; front yards and driveways may not be used for business purposes, and rear and side yards may be used only for horticulture with no storage.
Operating a business that changes residential character, uses front yards, or falls in an excluded category can bring zoning enforcement, cease-operation orders, and citations.
