Summary

Gulfport allows a home occupation in any dwelling only if it stays under 25 percent of the building's site coverage, employs no one but the resident, and generates no more traffic or parking demand than a normal residential block. The Urban Development Planning Division issues a certificate of zoning compliance before start-up and can revoke it for any violation.

Home occupation: ... An occupation for gain of support conducted in a dwelling unit only by members of a family residing in the dwelling unit and not including the employment of any additional persons, provided that the occupation is incidental to the residential use of the dwelling unit and is subject to the following provisions: a)Does not utilize more than twenty-five (25) percent of the building site coverage, and that no traffic shall be generated by such home occupation in greater volume than would be normally expected in a residential neighborhood, and that any need for parking generated by the conduct of such home occupation shall be met off the street. ... Applicant must apply for a certificate of zoning compliance along with providing a written description of the proposed home occupation, which is subject to all rules and regulations that may apply. At any time a violation of the conditions of approval or any other regulations is found, the certificate of zoning compliance is subject to be revoked.

Full Breakdown

Appendix A of Gulfport's zoning ordinance defines a home occupation as work conducted only by residents of the dwelling, with no additional employees, that stays incidental to the home's residential use. The site-coverage cap is 25 percent of the building site, traffic and parking demand must not exceed what a residential neighborhood normally sees, and any parking the business creates has to be met off the street. Only one on-premise sign is allowed, up to two square feet, mounted flat against the building and naming only the home occupation.

Producing or constructing items on-site requires Planning Commission approval and must add no visible light, sound, or nuisance to the area. Direct retail sales from the home are barred except infrequent deliveries of a verified national franchise line, such as Amway, Avon, Mary Kay, or Tupperware. Escort dating services and any state- or locally-licensed contractor trade are flatly prohibited. Equipment or work vehicles are capped at one one-ton vehicle and one trailer no longer than 24 feet, which cannot sit in the required front or side setback, and no equipment repairs may happen on the property.

To operate, the applicant must apply for a certificate of zoning compliance with a written description of the proposed business. If the Urban Development Planning Division later finds a violation of the approval conditions or any other regulation, it can revoke that certificate outright.

Violations & Fines

Once a certificate of zoning compliance is revoked, continuing to operate the home occupation is itself unlawful until every violation is resolved and the use is fully brought back into compliance. Appendix A does not set its own fine, so a violation falls under the Code's general penalty, Sec. 1-9: a fine up to $1,000, imprisonment up to 90 days, or both, with each day the violation continues counted as a separate offense.

Frequently Asked Questions

Can I hire an employee for my home-based business in Gulfport?
No. Appendix A's home occupation definition limits the work to family members residing in the dwelling and expressly excludes "the employment of any additional persons," so any paid help must work off-site.
Can I sell products directly from my Gulfport home?
Generally no. On-premises sales are barred except for infrequent deliveries of items from a verified national franchise line, such as Amway, Avon, Mary Kay, or Tupperware, which must be confirmed with the Urban Development Planning Division.
What happens if I violate my home occupation permit in Gulfport?
The Urban Development Planning Division can revoke your certificate of zoning compliance, and it becomes unlawful to keep operating until every violation is resolved and the business is fully compliant again.
Can I store business equipment or a work trailer outside at my Gulfport home?
Only a single one-ton work vehicle and one trailer up to 24 feet are allowed, and the trailer can't sit in the required front or side yard setback; all other equipment must stay inside the vehicle, trailer, or dwelling.
