Summary

Gulfport's Property Maintenance Code lets residents park in the front or side yard only on a paved or stabilized driveway of concrete, masonry paver, asphalt, stone or gravel. Without such a surface, parking shifts to the side yard or the part of the front yard next to it; rear yard parking is unregulated.

Section 302.8.1. Parking of vehicles in a residential district. In residential zoning districts which are not subject to recorded governing subdivision covenants that regulate parking in a yard, vehicles may only be parked in the front yard or side yard of a property if situated on a concrete, masonry paver, concrete paver, asphalt, stone, or gravel driveway. If no such driveway or designated parking area is present in the front and/or side yard or if such driveway or designated parking area is present, but is reasonably not available, vehicles may be parked in the side yard or in that portion of the front yard adjacent to the side yard. In instances where the aforementioned alternatives are not available, parking can occur immediately adjacent to the main driveway. Rear yard parking is not regulated by this section. For multifamily properties, vehicles may be parked in a designated parking area.

Full Breakdown

1 (Parking of vehicles in a residential district) governs any residential zoning district that isn't already subject to recorded subdivision covenants regulating yard parking. It requires that a vehicle parked in a front or side yard sit on a concrete, masonry paver, concrete paver, asphalt, stone or gravel driveway. If a lot has no such driveway or designated parking area, or the one it has isn't reasonably available, the code lets a vehicle park in the side yard, or in the part of the front yard next to the side yard, and only as a last resort immediately next to the main driveway.

Rear yard parking is explicitly carved out and not regulated by this section, and multifamily properties are handled separately: their vehicles must use a designated parking area rather than the yard itself. 1, with each additional day counted as a separate offense. 2, with further appeal available to the City Council for a $50 filing fee.

Violations & Fines

Parking on grass, dirt or another unapproved surface in a front or side yard is a Property Maintenance Code violation. The Department of Urban Development can issue a notice of violation, and if the surface isn't corrected, the city may assess a $250 civil fine under Section 106.4.1 for each violation, with continued noncompliance treated as a new offense each day; appeal runs to a hearing officer within seven days.

Frequently Asked Questions

Can I park on grass in my front yard in Gulfport?
No. Section 302.8.1 of the Property Maintenance Code amendments requires any vehicle parked in a front or side yard to sit on a concrete, masonry paver, concrete paver, asphalt, stone or gravel driveway; parking directly on grass or bare dirt in view of the street isn't allowed.
What if my house has no driveway?
If there's no driveway or designated parking area in the front or side yard, or the existing one isn't reasonably available, the code allows parking in the side yard, in the part of the front yard next to the side yard, or immediately next to the main driveway as a last resort.
Does this rule apply to parking behind my house?
No. Section 302.8.1 states explicitly that rear yard parking is not regulated by this section, so the paved-surface requirement only reaches front and side yard parking in residential zoning districts.
