Home-based businesses in Miami Beach require a Certificate of Use for Home Occupation and a Business Tax Receipt (BTR). Under Resiliency Code Section 7.5.5.6, no more than 25% of the dwelling unit (max 500 sq ft) may be used for the business. All business activities must occur indoors with no visible external evidence of the business operation.
Miami Beach regulates home-based businesses through Resiliency Code Section 7.5.5.6 and the Business Tax Receipt (BTR) licensing process. Operators must obtain both a Certificate of Use for Home Occupation and an annual BTR. The business area may not exceed 25% of the living area of the dwelling unit and garage, capped at 500 square feet. All activities associated with the home occupation must occur indoors, including storage of materials. The home occupation must not produce sound, vibrations, glare, odors, or other nuisances that impact neighbors. No employees who are not residents of the dwelling may work at the home business location. The business must not generate pedestrian or vehicular traffic beyond what is normal for the residential neighborhood. Applicants must submit a floor plan sketch with dimensions identifying the area to be used for the business, along with a notarized letter of approval from the property owner or property manager. Florida's Home-Based Business Bill (2021) provides some state-level preemption protections for home businesses, but local Certificate of Use and BTR requirements still apply.
