Summary

Hillsborough County exempts compliant home-based businesses from needing a zoning permit, but any business type that would need a Conditional or Special Use permit elsewhere in the code must get that same permit at home too.

City-specific rules exist: Temple Terrace, and Tampa have their own zoning & home occupation permits rules that differ from Hillsborough County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Home-based businesses shall comply with the following requirements. Approval of a zoning permit is not required for a home-based business that operates in compliance with these requirements, except that if approval of a Conditional Use permit or Special Use permit is required by this Code in any zoning district for a business of similar nature as the proposed home-based business, like-kind approval of the most stringent applicable permit shall be required for the home-based business. In cases where a Conditional Use permit is required in some zoning districts for the similar type of business and Special Use permit is required

in other districts for that type of business, approval of a Special Use permit shall be required for the home-based business. Full Breakdown

Under LDC Sec. 6.11.48, a home-based business in unincorporated Hillsborough County needs no separate zoning permit if it follows the section's operating standards: residential location, secondary use, employee limits, parking, signage and nuisance rules. That exemption disappears the moment the business type would trigger a Conditional Use or Special Use permit in that zoning district for a similarly-natured commercial use; where both permit types apply across districts, the more stringent Special Use permit governs. The rule does not excuse compliance with the Wellhead and Surface Water Resource Protection requirements, Florida Building Code, Accessibility Code or Fire Protection Code.

Violations & Fines

Operating a home business that needs Conditional or Special Use approval without it is a zoning code violation; Hillsborough County Code Enforcement can order compliance, require permitting, or pursue fines through the county's code enforcement process.
