Summary

Unincorporated Putnam County allows a home occupation by right on residential or agricultural property only if the business stays clearly secondary to the home's residential use and meets employee, vehicle and equipment limits. Cross a threshold, such as three or more outside employees, and a special use permit takes over.

These county ordinances apply to unincorporated areas of Putnam County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

With the exception of bone fide agricultural uses in agriculture zoning districts, a special use permit shall be required for any home occupation that exceeds any one of the following standards:i.The business employs three or more persons or independent contractors, other than persons residing on the premises, to engage in the occupation on the premises.

Full Breakdown

Putnam County Code § 45-110(7)(a) defines a home occupation, also called a home-based business, as a business conducted entirely within a residential building or an accessory structure that is clearly accessory, incidental and secondary to the dwelling's residential use and does not change the building's residential character or appearance. Subsection (b)(1) allows a home occupation by right on residential or agricultural property when it meets every listed criterion together: employees who work at the dwelling must also reside there, except that up to two outside employees or independent contractors may work on site while additional employees work remotely elsewhere; parking cannot exceed what a similar residence without a business would generate; residentially zoned property cannot store any heavy vehicle, while agricultural property is capped at one; heavy equipment cannot be stored or used on residential property; exterior modifications must keep the home's residential look and no retail transactions may occur anywhere but the dwelling; and the business cannot create off-lot noise, vibration, smoke, glare, odors or electrical interference.

Subsection (b)(2) requires a special use permit, except for bona fide agricultural uses in agricultural districts, once a home occupation employs three or more outside persons, or needs an outside heavy vehicle on residential land, or two or more on agricultural land, or requires outside heavy equipment on residential land.

Violations & Fines

Operating a home occupation beyond the by-right thresholds without a special use permit, or a business that changes the dwelling's residential character, is a zoning violation subject to a code enforcement notice and referral to the special magistrate under chapter 2, who can order compliance or shut down the unauthorized use.

Frequently Asked Questions

Can I run a home-based business on residential property in unincorporated Putnam County?
Yes, by right, if it meets County Code § 45-110(7)(b)(1): it stays secondary to residential use, on-site workers other than up to two outside employees must live there, parking and equipment stay at residential levels, and no retail happens outside the dwelling.
How many employees can work at my home business before I need a permit?
Section 45-110(7)(b)(2)(i) requires a special use permit once the business employs three or more persons or independent contractors who do not live on the premises.
Does a home occupation change my property's residential zoning?
No. Section 45-110(7)(a) defines it as a use that must remain clearly accessory, incidental and secondary to the dwelling's residential use and cannot change the property's residential character or appearance.
