The Town of Queen Creek Zoning Ordinance permits some businesses to operate from a residence as a 'Home-Based Occupation' - a business activity conducted as an accessory use to a dwelling unit - without obtaining commercial zoning. These provisions originated under the County's ordinance, carried over upon the Town's incorporation, and were expanded when the Town Council approved the revised Zoning Ordinance in August 2003. A home occupation must be operated and maintained so it does not interfere with the peace, quiet and dignity of the neighborhood. The area devoted to the home occupation must maintain a residential appearance and must not generate dust, odors, noise, vibrations or electrical interference. No more than 25% of the gross floor area may be used for the home occupation. Permitted examples include low-volume office (realty, insurance), internet-based business, beauty shop, seamstress, instruction (music, craft), word processing, telephone answering/message services, and door-to-door sales. Prohibited uses include retail sales on the property, medical/dental office and massage therapy, motor vehicle repair, vehicle display for sale/lease, animal care/grooming/boarding, commercial food preparation and catering, contractor's shops, mortuaries, body piercing, tattoos, and machine/metal working. Home occupations must conform to the Performance Standards in Section 9, Table 6.8-1, and to all applicable state and county statutes and Town ordinances.
Operating a prohibited use, exceeding 25% of floor area, generating nuisance dust/odor/noise/vibration, or running without the required permit can result in Town code-compliance (Neighborhood Preservation) enforcement and penalties under the Town Code.
