Surprise allows home occupations in residential zones subject to zoning code restrictions. Home businesses must not change the residential character of the neighborhood. Restrictions cover customer visits, signage, employees, outdoor storage, and the types of businesses permitted.
The City of Surprise zoning code permits home occupations in residential zones provided they maintain the residential character of the neighborhood. Home businesses must be conducted entirely within the dwelling and must not generate excessive traffic, noise, or visual impacts. The business must be clearly incidental and secondary to the residential use. Restrictions typically include: no exterior signage, no outdoor storage of business materials, limits on customer visits, and restrictions on the number of non-resident employees. Prohibited home businesses may include auto repair, retail storefronts, restaurants, and businesses involving hazardous materials. Some home occupations may require a home occupation permit from Community Development at (623) 222-1200. The zoning code distinguishes between minor home occupations (no customer visits) and major home occupations (limited customer visits) with different requirements. HOA communities may have additional restrictions on home businesses through CC&Rs.
Operating a home business that violates zoning restrictions results in Code Enforcement citations. Prohibited activities may be ordered to cease. Operating without required permits results in fines.
