Rochester allows home occupations in residential zones as accessory uses under the zoning code. The business must be incidental to the residential use, operated by the resident, and must not alter the residential character of the property or neighborhood.
Home occupations are permitted in residential districts with conditions. The business must be conducted within the dwelling by the resident. No more than 25% of the floor area may be used for business. External evidence of the business is prohibited. The number of non-resident employees is typically limited to one. Prohibited home occupations include auto repair, any use with outdoor storage, and businesses generating excessive traffic.
Operating without a home occupation permit carries fines of $100β$500. Businesses exceeding permit conditions receive warnings followed by permit revocation and fines of $200β$1,000 per day.
