Rockville's Chapter 25 Zoning Ordinance permits home-based business enterprises in residential zones provided the business does not diminish the residential character of the dwelling. The business must be conducted by a resident within the dwelling unit or accessory structure, and certain business types including vehicle repair, landscape contracting, and bed-and-breakfasts are excluded.
Under Rockville's Chapter 25 Zoning Ordinance, a home-based business enterprise is defined as any occupation that provides a service or product and is conducted within a dwelling unit or accessory structure by a resident of the dwelling unit without diminishing its residential character. The ordinance specifically excludes certain activities from the home-based business classification: bed-and-breakfast establishments, boardinghouses, day care facilities, display of goods not associated with a home-based business enterprise, landscape contractors, private educational institutions, tourist homes, and motor vehicle repair and maintenance. These excluded uses have their own zoning classifications and may require separate approvals. Home-based businesses must comply with general residential zoning standards including limits on noise, traffic, signage, and storage of materials. The business may not alter the exterior appearance of the residence or generate traffic, parking, or noise inconsistent with the residential neighborhood. Montgomery County also requires registration for home occupations classified as low-impact or major, and Rockville residents must comply with both city and county requirements.
Operating a home-based business that violates zoning conditions may result in a cease-and-desist order from Rockville's Zoning Division. Continued violations can lead to fines and legal action. Operating an excluded business type (such as vehicle repair) from a residence without proper zoning approval may result in immediate enforcement action.
