Florida's Home-Based Business Act, Fla. Stat. §559.955, bars the City of Sunrise from banning or singling out home-based businesses. Sunrise's home-occupation rule, Land Development Code §16-81, still requires the activity stay incidental to the dwelling.
Since 2021, Fla. Stat. §559.955 preempts local governments from prohibiting home-based businesses or regulating them differently from other businesses. Sunrise's Land Development Code §16-81 permits home occupations in residential districts under the statute's conditions: the use must stay secondary to the residence, employ no more than two nonresident workers, keep parking and traffic consistent with the neighborhood, and produce no excess noise, odor, vibration, or hazardous materials. A City of Sunrise local business tax receipt is still required. Deed-restricted condo and HOA communities like Sunrise Lakes, Welleby, and Sawgrass may impose stricter private covenants.
A business exceeding §559.955 limits loses its protection; Sunrise Code Compliance may issue a notice, impose daily fines, and order the use to stop. Operating without a business tax receipt adds penalties.
