Eden Prairie, MN Homelessness & Encampment Rules: Encampment Sanitation (2026)

Section 8.04, added by Ordinance No. 17-2015, makes it unlawful for any person to stop, stand, or park a vehicle on or within the limits of any street, as street is defined in City Code Section 11.02, for the purpose of camping, living, or sleeping, unless the City has erected signs designating that location as a campsite. Because the definition of street in Chapter 11 reaches the full public right-of-way, including boulevards and any land dedicated to public street use, the ban covers vehicle-based camping anywhere along the public roadway system, not only the paved travel lane.

Separately, Section 9.34, Obstructions on Public Property, requires anyone who wants to place, deposit, display, or offer for sale a fence, tent, or other obstruction on, over, across, or under public property to first obtain a written permit from the City Manager or a designee and then to comply with every term of that permit while taking precautions to protect the public; an electrical cord or device counts as an obstruction. Subdivision 3 separately bars dumping items such as nails, glass, cans, clothing, garbage, or building material on public property, and bars storing construction or demolition waste there without a Council permit, covering the debris and refuse that accumulates around an unauthorized camp.

Subdivision 5 makes each day a violation continues under Section 9.34 a separate offense, so an encampment or unpermitted structure left in place accrues a new violation daily until it is removed.
