Eden Prairie, MN Homelessness & Encampment Rules: Sit-Lie Rules (2026)

Section 9.33, titled Sleeping and Loitering in Streets or Public Places, contains two separate unlawful acts in Subdivision 2. Paragraph A bars loitering on public property except in parks, discussed separately at Subdivision 1's definition. Paragraph B is the sleeping ban itself: it is unlawful for any person to sleep upon streets or in or upon public buildings or structures, with no carve-out written into the text for parks, sidewalks, or any other public location. Because the ban covers streets and public buildings and structures broadly, it reaches sleeping in a doorway, on a bench attached to a public building, or inside a public structure such as a shelter or transit stop, not merely camping in a roadway.

The provision is part of Chapter 9, Public Protection, Crimes and Offenses, so violations are prosecuted the same way as the chapter's other disorderly-conduct sections: as ordinance violations enforced by the Eden Prairie Police Department, with the general Chapter 9 penalty in Section 9.99 making a violation punishable as a misdemeanor unless another provision states otherwise. The section does not create an exception for individuals experiencing homelessness or set separate enforcement steps such as a warning period or referral to social services; the text simply declares the described conduct unlawful.

Because Subdivision 2's paragraphs A and B are independent unlawful acts, a person could be found in violation of the sleeping ban even where the loitering ban's park exception would otherwise apply.
