Section 12.16.020, part of Chapter 12.16, Obstructing Streets and Sidewalks, states the prohibition in a single sentence: no pedestrian shall sit, lie or sleep in or upon any street, sidewalk or public way or any portion of one. The section carries no exception for daytime versus nighttime hours, for a particular commercial district, or for a person who has nowhere else to go; it applies citywide, on any street or sidewalk, at any time. It sits alongside § 12.16.010's ban on blocking business entrances and § 12.16.030's ban on obstructing pedestrian passage, and traces to the same 1970 ordinance, Ordinance 726. Chapter 12.16 was adopted citing the City's authority under Government Code § 38775 to prohibit and prevent obstructions on sidewalks, streets, alleys, courts, parks and other public places.
