Council Bluffs, IA Landscaping Rules: Native Plants (2026)

Council Bluffs treats any weeds, grass or similar growth over eighteen inches as a nuisance under CBMC 1.97.030 and requires owners to cut it under CBMC 4.19.010, but CBMC 4.19.050 lists exceptions to that duty. The flower garden exception covers gardens that are purposefully planted and specifically extends to ornamental grasses as well as natural grasses, meaning a homeowner can grow taller native or ornamental grass plantings inside a deliberately established bed without it counting as a weed violation. The only condition attached is that the garden stay maintained free from weeds, so the exemption protects the intended planting, not surrounding weed growth that creeps in around it.

The same section exempts vegetable gardens and wood perennials maintained under CBMC 10.52, and separately allows temporary erosion-control growth on active construction sites and growth on truly undeveloped land where terrain makes control impractical. None of the CBMC 4.19.050 exceptions extends to noxious weeds defined by Iowa Code Chapter 317, which stay unlawful regardless of height or garden status. Because the ordinance doesn't set a maximum garden height or require a permit, a resident planting an ornamental or native grass bed does not need city approval, but the administrative authority still investigates weed nuisance complaints and can require proof the bed is a purposeful, weed-free planting rather than uncontrolled growth if a neighbor complains.
