Ordinance NU-3437 (2023) rewrote the Weed and Vegetation Enforcement Act to protect a Planned Sustainable Landscape from the eight-inch height rule. Native beds must be edged, set back three feet from side and rear lot lines, and free of turf grass and noxious weeds.
Section 7.20.190(E) exempts a Planned Sustainable Landscape — a planned, intentional, maintained planting of primarily native plants, grasses, vines, shrubs or trees, including rain gardens and meadow vegetation. Four conditions apply: the owner maintains the material in healthy condition free of unintended vegetation; the bed excludes uncontrolled invasive plants, turf grass, and noxious weeds; boundaries are defined by edging or containment with no encroachment onto neighboring property; and a three-foot setback runs the length of side and rear lot lines. The setback is waived where the bed abuts a similar landscape area or a solid fence at least four feet tall. Section 7.20.120(K) excludes turf lawns simply left unmowed to go natural. No registration or city approval is required.
Beds failing the criteria are cited as Excessive Growth of Vegetation: ten-day notice, city abatement, cost assessment, and municipal court fines up to $500.
