Full Breakdown
City code declares weeds, grass, or other uncultivated plants a nuisance once they exceed 12 inches in height, or grow rank enough to harbor reptiles/rodents or create a fire hazard. Code enforcement notifies the owner; if the nuisance isn't abated within 10 calendar days of notice, the city may do the work itself and assess the cost against the property, backed by a lien. Owners can request an administrative hearing before the city manager's designee within 5 days of notice, but a hearing request does not stop the city from abating weeds/grass nuisances in the meantime. Narrow affirmative defenses exist for active crop or grazing land, heavily wooded underbrush, State highway right-of-way, and wildflower cultivation (weeds/grass up to 18 inches, March 1-June 15 only).
Violations & Fines
Unabated nuisance after notice: city may abate and lien the property for costs plus 10% interest; violation is also a misdemeanor under the general penalty section.
