Full Breakdown

Midland Code § 8-6-18(A)(4) makes it unlawful for any owner, occupant or possessor of a lot to let weeds, tall grass, brush, animal refuse or unsanitary matter accumulate or grow on the property. Subsection (B)(1) supplies the affirmative defense: weeds and tall grass under 12 inches tall, and brush under two feet tall, are not a violation. Cross the threshold and the owner is exposed to a misdemeanor fine under Subsection (C). If a 10-day written abatement notice goes unanswered, the City may enter the lot, mow it, and file a lien against the property for the cost under Subsection (E).
