Section 343.011(c)(4) makes weeds within 300 feet of another residence a public nuisance. The Commissioners Court created the Unincorporated Area Nuisance Abatement Program on August 16, 2016 to enforce 343.011, listing 'Weedy Lot' [C(4)] and 'Unsanitary Condition' [C(3)] among four violations. Section 343.022 requires the program to be run by a full-time county employee and to give the owner written notice before the county acts.
After written notice under THSC 343.022, an uncorrected weed nuisance may be abated by the county, which can charge the cost to the property and, under Section 343.011, seek an injunction in county or district court.
