(g) Each operator and passenger of a class three (3) electric power-assisted bicycle shall wear a properly fitted and fastened bicycle helmet that meets the current standards provided by either the U.S. Consumer Product Safety Commission or the American Society for Testing and Materials International.

Section 20-165(a) gives an e-bike rider all the rights, privileges and duties of a bicycle rider, and the e-bike is a vehicle to the same extent as a bicycle. Subsection (b) exempts the bike and its rider from the Virginia Code Title 46.2 requirements for driver's licenses, registration, certificates of title, financial responsibility, off-highway motorcycles, and license plates. Equipment rules sit in subsection (c). Since January 1, 2021, manufacturers and distributors must permanently label each e-bike with its classification number, top assisted speed and motor wattage, printed in Arial at least nine-point. Every e-bike must meet the federal bicycle requirements at 16 C.F.R. Part 1512, and every Class 3 bike needs a speedometer that shows miles per hour. Subsection (d) bars anyone from modifying the motor-powered speed capability or engagement unless the label is replaced afterward.
Class 3 bikes carry the strictest rules. Subsection (g) requires each operator and passenger to wear a properly fitted and fastened helmet that meets U.S. Consumer Product Safety Commission or ASTM International standards. Section 20-166 adds that no one under 14 may drive a Class 3 e-bike without the immediate supervision of a person at least 18, caps any e-bike at 25 miles per hour, and requires spill-proof, sealed, or gelled electrolyte batteries. Section 20-150 separately bars riding an e-bike on any sidewalk.
Violations & Fines
A violation of the e-bike provisions is a traffic infraction punishable by a fine of not more than $200 under §§ 20-1 and 20-132. The one misdemeanor is altering, changing or mutilating a frame number, which is a class 3 misdemeanor. Under § 20-134 the officer takes the rider's name and address and issues a summons: riders under 18 appear before the juvenile and domestic relations court, and riders 18 or older before the general district court. Section 20-133 also lets the chief of police request e-bike sale and rental records from vendors and lessors.
