Perth Amboy, NJ Noise from Specific Sources: Delivery Truck Noise (2026)

Section 304-10 of the Perth Amboy City Code, within Article III of Chapter 304, lists acts declared to be loud, disturbing and unnecessary noises, and the list is expressly not exclusive. Subsection I is the rule that reaches delivery activity: the creation of a loud and excessive noise in connection with loading or unloading any vehicle, or the opening and destruction of bales, boxes, crates and containers, is a violation. The rule follows the noise, not the vehicle type, so a box truck, a tractor-trailer or a van at a loading dock in the City of Perth Amboy is covered equally.

The standard is qualitative. The code prints no decibel limit and no hour window in subsection I, so the question is whether the noise from the loading, unloading or crate-opening is loud and excessive. Other subsections in the same section can apply to the same delivery. Subsection H covers vehicles so out of repair, or so loaded, as to create loud and unnecessary grating, grinding, rattling or other noise. Subsection P bars the operation between 10:00 p.m. and 7:00 a.m. of any pile driver, steam shovel, pneumatic hammer, derrick, steam or electric hoist or other appliance attended by loud or unusual noise. Subsection K bars excessive noise on a street adjacent to a school, church or court while in use, or adjacent to a hospital, provided conspicuous signs are displayed indicating a school, hospital or court street.

Truck movement is regulated separately in Chapter 414, Vehicles and Traffic, and those sections are traffic rules, not noise rules. Section 414-9 excludes trucks over four tons' gross weight from streets described in Schedule VI, except for the pickup and delivery of materials on such streets. Section 414-10 confines trucks over four tons to the designated truck routes. Section 414-10.1 prohibits operating a truck or vehicle over four tons' gross weight, or a trailer or semitrailer truck to which equipment is attached, on the Route 35 Industrial Connector Road between 6:00 p.m. and 6:00 a.m.
