Town Code § 38-3B(6) bars "operating or permitting the operation of any commercial equipment, including but not limited to air-conditioning and refrigeration systems," between 10:00 p.m. the previous day and 8:00 a.m. whenever that equipment creates a noise disturbance across a residential real property boundary or within a noise-sensitive zone. The section is written broadly enough to reach rooftop condenser units at restaurants and stores, walk-in refrigeration compressors, exhaust fans and similar mechanical equipment, not just window air conditioners, and it applies whether the equipment belongs to a business or an institution located next to residential property.

Compliance turns on the same "noise disturbance" definition used across Chapter 38: sound that endangers health or safety, or annoys or disturbs a reasonable person of normal sensitivities, per § 38-2, weighed against the factors in § 38-3A(2) such as the equipment's proximity to residential sleeping areas, the sound's duration, and whether it runs continuously through the night. A commercial property whose HVAC or refrigeration system runs constantly and audibly into adjoining homes after 10:00 p.m. is exposed under this section even if the equipment predates the residential development next door, since Chapter 38 does not include a grandfather clause for pre-existing equipment noise.
