Full Breakdown
Sec. 13-102(e) lists uses exempt from the numeric decibel table set out earlier in the same section, and the first is air conditioning equipment: an AC unit is exempt from Table I only while it is functioning in accordance with the manufacturer's specifications, with all of the manufacturer's standard mufflers and noise-reducing equipment installed and in proper operating condition, judged against standards set by the American Refrigeration Institute. m. Being exempt from Table I is not a blanket shield, however: Sec. 13-103(b) expressly states that noises prohibited under that separate 'unnecessary noise' section remain unlawful notwithstanding any Table I exemption in subsection 13-102(e), so a malfunctioning or poorly maintained AC unit that is excessive, unusual and a genuine detriment to neighbors can still be cited as an unnecessary noise even though it is technically outside Table I's reach.
The exemption language traces to Ord. No. 42-2004, § 1, adopted July 13, 2004, and was carried forward through the 2009 and 2017 amendments to the noise article without substantive change to the air conditioner provision itself. Enforcement and penalties for a violation of the broader noise article, including a unit found not to meet manufacturer specifications, fall under Sec. 13-104, which allows the court to confiscate repeatedly offending equipment after a third conviction within twelve months.
Violations & Fines
An air conditioner that is not running to the manufacturer's specifications, or missing its standard mufflers and noise-reducing equipment, loses the Table I exemption and can be cited like any other noise source under Sec. 13-101. Even a compliant unit can still be cited as an unnecessary noise under Sec. 13-103 if it is genuinely excessive and disturbs neighbors.
