Except as provided for in subsection (b) hereof, in Zoning Districts RS-12, RS-9, RS-6, RD-6, RM-12, RM-24, RM-36, RMH, CN, CO, CS, CM, CR, CD, IL, IG, IP, POS, and IC, no person shall operate any fixed machinery or equipment, or similar mechanical device in any manner so as to create any noise which would cause the noise level measured at the property line of the property affected by the noise emission to exceed the applicable fixed noise level in this section... The rule applies across nearly every zoning district: RS-12, RS-9, RS-6, RD-6, RM-12, RM-24, RM-36, RMH, CN, CO, CS, CM, CR, CD, IL, IG, IP, POS and IC. m. Standby equipment used only in emergencies is exempt from the section entirely, provided it does not exceed 75 dBA at the property line when it does run.
Violations & Fines
Violating Chapter 507's fixed-source noise limits is a minor misdemeanor under Section 507.99, with each day of continued violation charged as a separate offense. The Director of Pollution Control or another Agency member may enter and inspect equipment believed to be causing an unnecessary-noise violation, and refusing entry or obstructing an inspection is itself a separate violation of the chapter under Section 507.18.
