Toledo, OH Parking Rules: Towing & Impound Rights (2026)

When Toledo police order a tow, the vehicle does not go to the wrecker's own yard. TMC 765.13 requires that all vehicles subject to police ordered tows be promptly and directly delivered to the City of Toledo Police Impound Lot at the direction of the Police Department, and TMC 765.01(v) defines the Impound Lot as the City owned and operated tow yard. TMC 303.08(a) sets out the twelve grounds an officer may act on, running from a car blocking street cleaning or snow removal, through a vehicle left unattended after its operator was arrested or taken ill, to one carrying two or more unanswered parking tags or two or more unpaid camera notices of liability under TMC 313.12. Under TMC 303.08(b) the Police Division attaches a parking tag stating the violation the vehicle was impounded for and gives the owner written notice of the removal and the reason for it.

The money is set by ordinance rather than left to the tow operator. TMC 765.11 makes the owner pay the City a $160.00 towing fee per vehicle before the vehicle is released, and that figure is expressly exclusive of storage, of any fee for extraordinary services, and of the heavy duty schedule. Storage is billed separately under TMC 765.12: outside storage runs $20.00 a day for a passenger vehicle, utility trailer or truck under one and one-half tons, $19.00 a day for a motorcycle, and $27.00 a day for anything over one and one-half tons. Inside storage is $23.00, $21.00 and $32.00 a day for the same three classes, and TMC 765.12(c) allows the inside rate only where the Police Records Bureau ordered inside storage, and only for the period the vehicle was physically stored inside.

What the City pays the wrecker is a separate schedule, rewritten by Ordinance 401-22 on 8-16-22 to price tows by where they start. A passenger car, motorcycle, stake, panel or dump truck up to one-half ton earns the licensee a maximum of $100.00 for a tow inside Toledo or from a jurisdiction within its limits such as Ottawa Hills or Washington Township, $125.00 from a Lucas County jurisdiction bordering the city such as Sylvania, Maumee or Oregon, and $150.00 from a non-bordering one such as Whitehouse, Waterville, Berkey or Jerusalem Township. Heavy duty towing and recovery for vehicles rated from 7,000 pounds gross weight runs on its own schedule at the discretion of the Director of Public Safety, and extraordinary expenses caused by weather, environmental or tactical emergencies are billed on to the vehicle owner.

Which company gets the call is not the driver's choice either. TMC 765.06 has the Director of Public Safety draw police towing districts, has the Police Records Section keep an alphabetical police tow list for each district, and rotates calls in order among the licensees on it, with a separate rotation for heavy duty work and a temporary suspension of the rotation when the Police Department deems a life threatening emergency to exist. A called licensee must reach the scene within thirty minutes and be ready to begin preparing the vehicle (TMC 765.09), and after a collision must clear the glass, metal, plastic and vehicle parts and treat spilled fuel, oil or coolant with a City approved floor dry product (TMC 765.10, Ordinance 112-21, passed 3-2-21).

Toledo's private property rule, TMC 351.22, is the local build on Ohio R.C. 4513.60. The sign creating a private tow away zone must be at least eighteen inches by twenty-four inches, visible from all entrances, and must carry the recovery phone number, the address the vehicle will be taken to, and a statement that the vehicle may be recovered at any hour on proof of ownership for no more than the third party tow and storage charges specified in Chapter 765. Two conditions are Toledo's own addition: the storage location must sit inside the corporate limits, be a licensed storage facility, be well lighted and be within reasonable distance of a public transportation route, and under TMC 351.22(d) no property owner may use a towing operator that is not licensed under Chapter 765. A driver who arrives after the vehicle has been hooked up but before it leaves the lot is entitled under TMC 351.22(e) to pay a fee and take the vehicle, on condition of moving it immediately.

Recovering a vehicle impounded over parking infractions runs through TMC 309.07. The owner pays the fines due under TMC 309.04 and 309.05 plus towing, storage, impound and administrative fees and costs, or, when contesting the ticket, posts a bond or cash deposit in the same amount, which TMC 309.07(d) caps at $1,000. No vehicle is released until every unpaid parking infraction judgment is satisfied and the claimant produces proof of identity and ownership. TMC 303.08(e) offers a second route where the fee itself is disputed: on satisfactory proof of identity and ownership the Police Division may release the vehicle on the claimant's written promise to appear in Municipal Court on a named date.
