Eastvale Municipal Code 8.52.060(4) prohibits sound-amplifying equipment and live music entirely between 10:00 p.m. and 8:00 a.m. At all other times, sound from amplified equipment or live music must not be audible to the human ear at a distance greater than 200 feet.
Eastvale regulates amplified sound directly in its noise ordinance under the 'special sound sources' section, EMC 8.52.060(4). That subsection states that no person shall install, use, or operate sound-amplifying equipment, or perform or allow live music, unless two requirements are met: (a) sound-amplifying equipment and live music are prohibited between 10:00 p.m. and 8:00 a.m.; and (b) at any other time, the sound from the equipment or music must not be audible to the human ear at a distance greater than 200 feet from the equipment or music. 'Sound-amplifying equipment' is defined in EMC 8.52.030 as a loudspeaker, microphone, megaphone, or other similar device. The 200-foot audibility test is more generous than the 100-foot test that applies to stereos, audio equipment, and power tools under EMC 8.52.060(2)-(3), reflecting that amplified events are treated as a distinct category. The ordinance also notes that these requirements control over any conflicting conditions of approval in an underlying land-use permit. Where an event cannot meet these limits, the operator can apply for a single-event or continuous-event exception under EMC 8.52.070; a continuous-event exception requires a public hearing before the planning commission.
Operating amplified sound or live music during the 10:00 p.m.-8:00 a.m. ban, or so that it is audible beyond 200 feet at other times, is a separate violation of Chapter 8.52. Penalties under EMC 8.52.100 are a $500 minimum first fine, $750 second, and $1,000 (and/or up to six months in county jail) for further violations within 180 days, with each day a separate offense. Enforcement is by the chief of police and community development director (EMC 8.52.080).
