Lee County, NC Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Lee County Code § 12-34(2) lists outdoor loudspeaker and amplification use in a residential area as an enumerated prohibited noise under the county's Noise Control Ordinance, adopted under G.S. 153A-133, G.S. 153A-123 and G.S. 14-4 per § 12-31. The ban covers any loudspeaker, loudspeaker system, noise amplification device or similar device used outdoors for any purpose, and it applies broadly to residential areas as defined in § 12-32, which reaches land zoned or actually used for sleeping purposes, including homes, apartments, hospitals, nursing homes, hotels, schools, libraries and churches that are open and operating.

The only carve-out in the section itself is for noncommercial public speaking, public assembly or other activity for which a permit has been issued by appropriate authority, meaning a resident cannot simply claim a free-speech exemption without first securing that permit. The Sheriff has primary enforcement authority under § 12-37, and § 12-38 requires a warning before a citation, after which civil penalties escalate from $200.00 to $400.00 to $500.00 for repeated violations, or the county can pursue a Class 2 misdemeanor charge under § 12-38(b)(2) with fines up to $500.00 and up to 30 days in jail for repeat offenders.
