Full Breakdown

Amplified sound is regulated in § 69-7B of the Monroe Township Code (Middlesex County), part of the Noise Control Ordinance for Stationary Sources. Subsection (1) covers radios, televisions, phonographs and similar devices that reproduce or amplify sound. Three tests apply: unnecessary noise at 50 feet from the device when it runs in or on a motor vehicle on a public right-of-way or public space; unnecessary noise for any person other than the operator; and a sound level across a real property line, or through partitions common to two or more persons within a building, that exceeds an applicable Table 1 limit.

Subsection (2) covers loudspeakers, public address systems and similar devices: they cannot be used between 10:00 p.m. and 8:00 a.m. the following day if the sound creates unnecessary noise across a residential real property line. Subsection (8) covers places of public entertainment, where operating any radio, television, phonograph, drum, musical instrument, sound amplifier or similar device above an applicable Table 1 limit is prohibited. The residential figures in Table I of § 69-6 print 50 under the 10:00 p.m. - 7:00 a.m. column. Section 69-3 defines noise as any sound of such level and duration as to be or tend to be injurious to human health or welfare or that would unreasonably interfere with the enjoyment of life or property.

Section 69-7A exempts noncommercial public speaking and public assembly activities conducted on any public space or public right-of-way. The Health Department administers the article through the Noise Control Officer, who can grant special variances consistent with N.J.A.C. 7:29 (§ 69-8B). Fee-charging public entertainment events separately need a Township Council special permit under Chapter 67.

Violations & Fines

A violation draws a notice of violation or an abatement order from the Noise Control Officer (§ 69-9A and B). The penalty is not more than $100 for each offense. A willful or knowing violation costs not less than $100 and not more than $500 per offense, and each day of a continuing violation is an additional separate offense (§ 69-9C).
