Barking dog rules in Concord, NC β also called nuisance dog, dog noise, or excessive barking ordinances β define when a barking dog becomes a code violation and how complaints are handled.
Concord Code Sec. 30-204 makes it a violation to allow unreasonably loud and raucous noise from any animal or bird in your care, such as a persistently barking dog. Day-to-day animal complaints are handled by Cabarrus County Animal Control, which serves Concord under a unified ordinance.
The City of Concord addresses animal noise directly in its noise ordinance, Chapter 30, Article V. Sec. 30-204 lists, as a per se violation, 'unreasonably loud and raucous noise emitted by an animal or bird for which a person is responsible.' A person is responsible if they own, control or otherwise care for the animal. Sounds from animals in licensed animal shelters, kennels, veterinary hospitals, pet shops and pet kennels that comply with the Code's licensing and permitting provisions are exempt. In practice, day-to-day barking-dog enforcement in Concord is handled through the unified animal-control program run by the Cabarrus County Sheriff's Office Animal Control, which partners with the Concord Police Department on barking-dog and similar calls that do not require seizing an animal. A complainant may also report a noise violation to the Concord Police Department, which investigates and may issue a criminal or civil citation if probable cause exists (Sec. 30-208). The general unreasonableness factors in Sec. 30-203, such as the duration of the sound and proximity to sleeping areas, apply to barking complaints.
An animal-noise violation under the city ordinance is a misdemeanor (Sec. 30-210): $10.00 for a first offense and up to $500.00 for repeats, with a possible $500.00 civil penalty. Cabarrus County animal-control penalties may apply separately for nuisance or at-large animals.
