Quiet hours in Concord, NC β also called the noise ordinance, nighttime noise rules, or residential quiet time β define the hours during which excessive noise is prohibited.
Concord's noise ordinance (Code of Ordinances Sec. 30-204) sets nighttime quiet hours of 10:00 p.m. to 7:00 a.m. for yelling, shouting and noise from commercial establishments near homes. It also bars amplified sound from radios and stereos that is plainly audible 30 feet away in residential areas at any hour.
The City of Concord regulates noise under Chapter 30, Article V of its Code of Ordinances. Sec. 30-203 broadly prohibits any unreasonably loud and raucous noise that disturbs persons of ordinary sensibilities. Sec. 30-204 lists specific per se violations. Yelling, shouting, hooting, whistling or singing in residential or noise-sensitive areas or public places is prohibited between 10:00 p.m. and 7:00 a.m., or at any time if it unreasonably disturbs the quiet, comfort or repose of reasonable persons. Unreasonably loud and raucous noise from a commercial establishment (including any outdoor area it controls) that is plainly audible 30 feet or less from residential property is prohibited between 10:00 p.m. and 7:00 a.m. Amplified sound from radios, televisions, boom boxes, stereos and musical instruments is a violation when it is plainly audible at 30 feet from a person in a residential or noise-sensitive area, or 50 feet in commercial, industrial or public spaces, at any hour. Vehicle horns may not be sounded more than ten consecutive seconds except as a danger warning. Enforcement is by the city manager, chief of police or designees (Sec. 30-209), and violators must first be ordered to cease before a citation issues.
First violation is a misdemeanor punishable by a $10.00 fine (Sec. 30-210, citing Sec. 1-6 and G.S. 160A-175 and 14-4). Second and subsequent violations are misdemeanors punishable by up to $500.00, and violators may also face a $500.00 civil penalty recoverable as a debt.
