The City of Concord limits construction noise through its noise ordinance, Chapter 30, Article V. Sec. 30-204 makes it a per se violation to emit unreasonably loud and raucous noise from the construction, demolition, alteration or repair of any building, or from the excavation of streets and highways, other than between the hours of 7:00 a.m. and 7:00 p.m. on weekdays. Read literally, the ordinance permits this construction-noise window only on weekdays, meaning loud construction on weekends and overnight falls outside the stated allowance. In cases of emergency, construction or repair noises are exempt. In non-emergency situations, a code enforcement officer may issue a permit on application to allow loud construction or excavation noise between 7:00 p.m. and 7:00 a.m., but only if the officer determines public health and safety will not be impaired and that loss or inconvenience would otherwise result to an interested party. General noise factors in Sec. 30-203 (time of day, duration, proximity to homes and noise-sensitive areas) also apply. Routine, reasonable construction during the allowed hours is generally treated as lawful unless it becomes unreasonably loud and raucous.
A violation is a misdemeanor under Sec. 30-210: $10.00 for a first offense (per Sec. 1-6, G.S. 160A-175, G.S. 14-4) and up to $500.00 for repeat offenses, plus a possible $500.00 civil penalty. Officers must order the noise to cease before citing (Sec. 30-209).
