Broomfield, CO Noise Ordinances: Construction Hours (2026)

Section 9-36-030 exempts certain construction activity from the Schedule 9-36A decibel ceilings, but only during set hours. Subsection (I) covers residential construction, not including minor remodeling or additions to existing homes, within 500 feet of occupied residences: that work may be performed only from 7:00 a.m. until 7:00 p.m. Monday through Friday, and from 9:00 a.m. to 6:00 p.m. on Saturdays, Sundays and holidays, unless the city council's resolution approving the project sets different hours. Outside those windows, or beyond whatever hours a project-specific council resolution allows, construction noise loses its exemption and must meet the Schedule 9-36A limits like any other sound, 55 dB(A) daytime and 40 dB(A) overnight in residential districts.

Subsection (F) separately covers temporary construction, defined as minor remodeling and additions to existing homes plus maintenance or repair activity: that work gets a wider 7:00 a.m. to 10:00 p.m. window but is capped at 88 dB(A), a numeric ceiling rather than a blanket exemption. Section 9-36-040 layers on a further restriction for trash compaction and collection, barring that activity in a residential district between 10:00 p.m. and 7:00 a.m. Chapter 9-36 traces to Ordinance 862 from 1989, with the exceptions section last amended by Ordinance 1794 in 2005.

No fine is written into Chapter 9-36 itself, so a violation of the construction-hours limit is punished under the citywide general penalty, Section 1-12-020: a fine up to $2,650.00, imprisonment up to 364 days, or both.
