Kauai County, HI Noise Ordinances: Construction Hours (2026)

Kaua'i County Code Section 22-7.17, part of Article 7's "Specifications for Grading, Grubbing and Stockpiling," sets the island's grading-specific work-hour limit: no work between 7:00 p.m. and 7:00 a.m. Monday through Friday, and no work at all on Saturdays, Sundays or holidays unless the County Engineer first gives written permission (Subsection (h)). The restriction sits inside the broader Sediment and Erosion Control Ordinance (Sections 22-7.1 to 22-7.27), which the County Engineer in the Department of Public Works administers, rather than in a general noise chapter, so it specifically covers earthmoving, grubbing and stockpiling operations rather than every type of construction activity on a site.

The same Section 22-7.17 pairs the hours limit with technical grading standards, including slope-control benching for cuts or fills over 15 feet, a 10-acre cap on land opened for grading or grubbing at one time absent an approved dust and erosion plan, and a ban on letting graded material or debris fall onto adjoining properties. Because Section 22-7.17 sits among the "specifications" a grading, grubbing or stockpiling permit enforces, the County Engineer can write the after-hours limitation into permit conditions under Section 22-7.11 and can suspend or revoke a permit under Section 22-7.15 if a permittee keeps working outside the allowed hours.

Violations of the hours rule are enforced the same way as any other Article 7 violation: as a misdemeanor under Section 22-7.21, with civil fines up to $10,000 per day available under Section 22-7.20.
