Rochester Hills, MI Noise Ordinances: Construction Hours (2026)

Section 18-9 states that construction or associated activity under a validly issued building permit 'shall only be permitted during the hours of 7:00 a.m. to 8:00 p.m., Monday through Saturday, exclusive of holidays.' The building permit holder is responsible for compliance by any contractor, subcontractor or worker on site. Section 18-10 separately bars construction on Sunday and on the seven listed holidays (New Year's Day, Easter, Memorial Day, July 4, Labor Day, Thanksgiving and Christmas) unless the mayor grants special written permission upon a showing of hardship.

That written permission must specify the allowed hours, be kept on site for inspection by building or engineering staff or Oakland County Sheriff's deputies, and be posted at each vehicular entrance in letters at least two inches tall, legible from 50 feet, during the restricted period. Two exceptions excuse a project from the Sunday/holiday permission requirement: work on an existing single-family home where no neighbor complaint has been received (a single complaint ends the exception going forward), and any site with no occupied home within 1,000 feet.

The schedule of civil fines in § 66-37 sets the penalty for both sections at $70.00 for a first violation, $150.00 for a first repeat, and $500.00 for a second or subsequent repeat violation, all payable to the city's ordinance violations bureau.
