Rochester Hills, MI Noise Ordinances: Vehicle Noise (2026)

Article VII of Chapter 98, "Motorcycles and Certain Recreational Vehicles," is the city's dedicated vehicle-noise ordinance. Section 98-201 defines "motorcycle" broadly to include not only street motorcycles but also all-terrain vehicles, go-carts, trail bikes and drag bikes, so the noise rule reaches far beyond street bikes. Section 98-202 records the city council's finding that uncontrolled operation of these vehicles "has become a public nuisance within the city due to loud and raucous noises, noxious odors and excessive dust." Section 98-205(a) then flatly prohibits operating a motorcycle "in such a manner as to create excessive, unusual or unnecessary noise," and subsection (b) requires every motorcycle so operated to carry "an efficient muffler which will ensure noise levels comparable to that of a private passenger automobile," meaning a straight pipe or a removed muffler is itself a violation regardless of how the vehicle is driven.

Subsection (c) lists two specific causes the city treats as automatically excessive: racing the engine or repeatedly accelerating and decelerating it, outside of maintenance work, and abrupt or violent acceleration, including a launch hard enough to lift the front wheel off the ground. The article sets no fine schedule of its own, so a citation for violating Sec. 98-205 falls under the Code's general penalty clause, Sec. 1-16: because the section is not designated a municipal civil infraction, it is presumed a misdemeanor punishable by up to 90 days in jail, a fine of up to $500.00, or both, and each day the noisy equipment remains in use counts as a separate offense. The Oakland County Sheriff's Office, which polices Rochester Hills under contract, and state police officers enforce offenses under this article.
