Royal Oak, MI Noise Ordinances: Construction Hours (2026)

Section 278-37, Disturbances of the Peace, Construction Activity, amended August 26, 2024 by Ordinance No. 2024-11, bars any person from causing construction noise louder than what is normally present at the location when no construction is underway, covering erection, excavation, demolition, alteration or repair of a building, street, highway or parking area, outside the window of 7:00 a.m. to 8:00 p.m. Monday through Saturday and 10:00 a.m. to 6:00 p.m. Sunday. Three exceptions apply: necessary night excavation or repair of streets, highways or public utilities performed for the City, county, state or a public utility when needed to protect public health, safety and welfare; work under a special street-work permit issued by the City Engineer; and work under a special permit the Building Official may grant for a genuine emergency threatening public health, safety and welfare, or for extenuating circumstances amounting to an unnecessary hardship.

The same chapter requires contractors to store construction materials and equipment in an orderly, protected fashion, keep the site covered or screened where the building code requires it, provide enough refuse containers to prevent litter and rodent access, and control airborne dust and soil, including continuous water spray during structure demolition, so dust does not travel beyond the property lines. The Building Official, the Director of Public Safety, and their authorized representatives, expressly including police officers and building inspectors, enforce the section.
