Southampton, NY Noise Ordinances: Construction Hours (2026)

Rather than banning construction noise outright, § 235-4.A of the Town's noise chapter exempts it from the § 235-3 decibel standard, but only within fixed hours. On weekdays, construction activities are exempt between 7:00 a.m. through 7:00 p.m., Monday through Friday, covering both the work itself and the associated use of construction devices or the noise produced thereby. On weekends, the window narrows to between 8:00 a.m. through 6:00 p.m. Saturday and/or Sunday. Both exemptions require that such activities and equipment comply with the other provisions herein, meaning a contractor still cannot exceed the underlying dBA and octave-band limits in § 235-3 even inside the permitted hours; the exemption removes the general blanket prohibition, not the numeric ceiling, from ordinary daytime work noise.

Once work continues past 7:00 p.m. on a weekday or 6:00 p.m. on a weekend, or starts before those windows open, the exemption no longer applies and ordinary construction equipment noise becomes a straight violation of the chapter. The exceptions list in § 235-4 was most recently amended by Local Law No. 31-2025, adopted September 9, 2025. Emergency construction or repair work performed by or for the State, Suffolk County, the Town, the Long Island Lighting Company or a telephone or utility company is separately and unconditionally exempted under § 235-4.A(15), regardless of hour. This hours-based framework applies only in the unincorporated hamlets; Southampton Village and the Town's other incorporated villages regulate construction noise under their own codes.
