Southampton, NY Parking Rules: Driveway Rules (2026)

Chapter 330's Article XV, Supplemental Use and Dimensional Regulations, governs where residents outside Southampton's incorporated villages may park vehicles on their own property. Section 330-77A states plainly that accessory off-street parking areas shall not be located in a required front yard or side yard, so a driveway pull-off, parking pad or paved area used to satisfy off-street parking requirements cannot sit in the setback area facing the street or along the side lot line. Where parking is placed in a rear yard, it must be kept not less than 10 feet from any property line, a buffer meant to separate parked cars from neighboring lots.

This sits alongside § 330-76F, which requires that accessory off-street parking and truck loading areas be improved in accordance with Town specifications, giving the Building Inspector authority over surfacing standards for these areas. The rule is Town-wide across the unincorporated hamlets, from Hampton Bays to Flanders, and applies regardless of the size of the residence or lot, though it is separate from the specific standards that apply to nonresidential parking lots elsewhere in the same chapter. A driveway itself, as distinct from parking or standing areas, is treated separately: § 330-76E allows an access driveway to be located within a required yard even though parking areas cannot be, so the restriction targets where a vehicle stops and sits, not the travel lane leading to a garage or house.
