Full Breakdown

Southborough regulates construction noise by who is doing the work and when. Chapter 130, adopted by Town Meeting on 5-4-2022 (ATM Art. 26), sets three time windows in § 130-3.

Homeowner work is work by an owner or occupant of a residential property that generates noise, including renovation, construction, landscaping and property maintenance. Its noise is allowed between 7:00 a.m. and 8:00 p.m. on weekdays, and between 8:00 a.m. and 9:00 p.m. on Saturdays, Sundays and Holidays.

Contracted Work means businesses or other entities retained to do work on property, including renovation, landscaping, property maintenance, construction, demolition and deliveries. Its noise is allowed between 7:00 a.m. and 7:00 p.m. on weekdays and between 8:00 a.m. and 6:00 p.m. on Saturdays. Contracted Work shall not be allowed on Sundays or Holidays.

Work that generates an unreasonable noise disturbance beyond the property line under a New Construction Permit or a Demolition Permit is allowed only between 7:00 a.m. and 6:00 p.m. on weekdays and between 8:00 a.m. and 2:00 p.m. on Saturdays, and not on Sundays or Holidays. A New Construction Permit is a permit for new residential or commercial construction on any lot, excluding renovations and additions. The six Holidays are New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day.

Section 130-5 exempts emergency activities such as storm cleanup, power outages, snow removal and generators, necessary work on bridges, streets or highways or public utility installation by or for the Town, a utility or the Commonwealth, and farming activity. Under § 130-7(D) the Select Board can grant temporary exceptions of no more than three days and can require notice to all abutters within 300 feet.

Violations & Fines

Section 130-6 sets a warning for the first offense, $50 for the second offense within 180 days of the first, $100 for the third offense within 180 days of the second, and $300 for each succeeding offense within 180 days of the preceding one. The Enforcement Official, a designated police officer, can issue a warning instead of a fine. Each day of violation is a separate offense, and the Police Department enforces the chapter under § 130-7(A).
